By the authority granted in the Pocatello Municipal Code, Section 15.02.010 and the International Fire Code, Section 104.1, The fire code official is hereby authorized to enforce the provisions of this code and shall have the authority to render interpretations of this code, and to adopt policies, procedures, rules and regulations in order to clarify the application of its provisions. …., the following regulations shall apply:
Until further notice, all discharge of fireworks of any type is prohibited within the areas of the City of Pocatello as shown on the attached map and street index.
The state of vegetation on public lands surrounding the city requires that we take every possible precaution to prevent a major fire in these areas.
According to previous actions by the Pocatello City Council, only legal “safe and sane” fireworks may be discharged in the non-prohibited areas of the city, and only between June 28, 2008 and July 6, 2008.
Violation of the above regulations is a violation of the 2003 International Fire Code, and is punishable as a misdemeanor. Persons violating this regulation will be cited and will be held liable for the suppression costs of any fires they may start. In the case of minors, parents may be held liable.
