BOISE – The Idaho Department of Lands has directed Waterford Park Homes, LLC, to pay a $2,500 fine for work it had done at Harbor View Marina in Bayview on April 17, 2007, without a permit.
A Cease and Desist Order and Notice of Violation for the unauthorized activity was issued on April 18. A letter demanding payment of the fine – the maximum allowed under Idaho Code §58-1308 – was issued May 15.
The unauthorized work and previously conducted maintenance work appears to have had significant impacts on kokanee spawning gravels as well as kokanee fry. The Idaho Department of Lands is working very closely with the Idaho Department of Fish and Game to fully assess and understand the impacts on this sensitive resource.
Coordination with the Idaho Department of Fish and Game likely will result in recommendations of restoration, mitigation and future actions related to this violation. Idaho Code § 58-1309 authorizes the state to order mitigation in addition to penalties.
